There are heavy fines and serious implications for not disposing of your waste correctly.
The Environmental Protection Act of 1990 places a ‘Duty of Care’ on all businesses over the trade waste they produce. As an owner or operator, you have a legal responsibility to make sure that all business waste generated is disposed of correctly.

The cost of not disposing of business waste correctly
Don’t fall foul of the law, here are the key things to consider.
Remember, it is a criminal offence for failing to do any of the following:
- Check you are using a registered waste carrier
- Sort and store waste safely and securely
- For each load of waste that leaves your premises complete a waste transfer note
- To ensure you follow the correct duty of care, double check where your waste will end up with the carrier
If you don’t store your waste correctly you can be fined a fixed penalty notice of £80. A larger fine of £300 may be issued if you fail to produce a waste transfer note on request.
Other offences may lead to fines up to £50,000 or a 12-month prison sentence, so it’s always better to be safe than sorry.
